We appreciate your interest in the game “D.A.M.N!”, website https://www.dam-n.com, online communities, owned and operated by Sole Proprietor Komisarenko Maksym (together with our services and products, our “Services”).
Sole Proprietor Komisarenko Maksym (“Developer”, “we” or “us” or “our”) respect your privacy and is committed to protecting your Personal Data (as defined below). This privacy policy describes how your Personal Data is collected, handled and stored as well as your data protection rights.
“Personal Data” or “Personal information” means any information about an individual from which that person can be identified directly or indirectly. It does not include data where identity is removed (anonymous data). The notion of Personal Data covers all information defined as personal data under Art. 4 (1) GDPR.
This privacy policy is designed to apply to our Website visitors and users of our Services on a global basis.
1Controller of your Personal Data
Sole Proprietor Komisarenko Maksym (15000, Ukraine, Chernihiv Region, Ripky District, urban-type settlement of Ripky, 18 Popudrenka Street) is the data controller within the meaning of Art. 4(7) GDPR with respect to all personal information collected through the Website and Services. Accordingly, Developer is responsible for, and controls, the processing of your personal information collected through the Services.
The information provided to or collected by us from players and website visitors is strictly limited to operating, providing, maintaining, securing, and improving the Game, Website, and related Services.
Developer acknowledges that you have the right to access your Personal Data. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to Developer (the data controller). Upon receiving a request to access, modify, or remove your Personal Data, we will respond within a reasonable timeframe and in accordance with applicable data protection laws.
If you wish to contact us, you can find our contact details at the end of this privacy policy.
2Types of Data and Data Collection
Developer respects your privacy and processes only the minimum amount of Personal Data necessary to provide our Services.
Data is collected through the following methods and systems:
2.1 Data Received from Steam
When you launch the game through Steam, we receive the following data from the Steam client in order to identify you and enable multiplayer features:
- Steam ID (SteamID64): your unique Steam account identifier, used to identify you within the game session.
- Steam Persona Name and Avatar: your public Steam display name and profile picture, shown in menus and in game lobbies.
- Steam Authentication Ticket: a short-lived token issued by Steam and passed to Epic Online Services, which uses it to sign you in to the online services. We do not store this token.
In addition, while you are in a lobby or a match, the game publishes your current status and a join link to Steam Rich Presence, so that your Steam friends can see what you are playing and join you. This information is visible to your Steam friends according to your own Steam privacy settings, which you control in Steam and not in the game.
2.2 In-Game Data and Telemetry
To maintain leaderboards, track achievements, and improve game balance, we collect gameplay analytics. This data is linked to an Epic Online Services (EOS) Player ID (not externally linked to your Steam profile) and stored in our secure Oracle Database. This includes:
- Match IDs, participants, outcomes (winner/loser), and match duration.
- In-game actions (e.g., moves, ultimate abilities used, dice rolls) and post-match statistics (e.g., kills, distance traveled).
- Match results and stats are retained for a rolling period of 30 days strictly for achievement tracking and gameplay statistics, after which they automatically expire.
- We do not automatically upload crash logs. Local Player.log files are stored strictly on your device. You may choose to share them with us manually via the Steam bug report form.
- Your explicitly selected language preference, saved to provide localized in-game text and content.
2.3 Website and Analytics (dam-n.com)
Our public web presence is designed with a minimal data footprint:
- We use Cloudflare Web Analytics, which provides cookie-free, privacy-respecting insights into website traffic.
- If and when cookies are used on our website, they are strictly limited to essential cookies (e.g., session management, cookie consent settings).
3Use of Personal Data and Legal Bases
The reasons the Developer uses your personal data depend on how you interact with Services. Because we practice strict data minimization, we only process your information for the following purposes and on the following legal grounds:
To Perform Our Contractual Services (Providing the Game): When you launch and play our game via Steam, Developer processes your data to perform agreement to provide you with the multiplayer gaming experience. This includes using your Steam ID and EOS Player ID to authenticate your session, securely connect you to matchmaking servers, synchronize your in-game progression, and ensure the game functions properly.
For Our Legitimate Business Interests: We use gameplay analytics and telemetry based on our legitimate interest to maintain and improve the game. This includes analyzing match outcomes, player actions, and crash reports (if submitted) to balance game mechanics, troubleshoot technical issues, optimize server performance, and detect cheating or toxic behavior to ensure fair play.
Based on Your Consent: In specific cases, we may ask for your explicit consent to process certain data. For instance, if we implement in-game Voice Chat in the future, its usage will be strictly opt-in. Similarly, we will request your consent before placing any non-essential cookies on our promotional website (dam-n.com). You are always free to deny or withdraw your consent at any time without negative consequences to your core gaming experience.
To Comply with Legal Obligations: We may process, retain, or share your data if we are legally required to do so. This includes responding to lawful requests from law enforcement agencies, cooperating with legal proceedings, or protecting the safety, rights, and property of our studio, our players, or the public.
4Data Security
We have implemented strict technical and administrative security measures designed to protect your data from unauthorized access, disclosure, or modification:
All data transmitted between your game client and our servers is securely encrypted using industry-standard protocols. To ensure your EOS Connect ID login sessions remain safe, we utilize secure, short-lived authentication tokens, and access to our databases is strictly controlled so that only our authenticated backend systems can view or modify your information. To prevent client-side manipulation and protect the integrity of match results, our game relies on a server-authoritative architecture that securely handles critical game mechanics. Additionally, any game logs generated locally on your device are designed to be completely free of Personally Identifiable Information (PII) or sensitive data. Finally, in the event of a data security incident, we will promptly notify the relevant supervisory authorities and affected individuals as required by applicable law.
We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected, including providing access to the Game, maintaining multiplayer services, tracking achievements, and resolving technical issues. Match telemetry and player stats linked to your EOS Player ID are retained for the operational lifecycle of the Game. If you request account deletion or data erasure, we will process your request within 30 days, retaining only minimal data strictly required to satisfy legal or regulatory obligations.
Your own practices are also important for the protection of your privacy. Since our game utilizes your Steam account for authentication and profile display, please keep the following in mind:
- Be careful of what you share publicly. Do not share personal information (like your real name, address, or phone number) in the in-game text chat or on our community Discord server. We have no control over what other players might do with the information you voluntarily share in public lobbies.
5Data Protection Rights
Subject to applicable law, you hold several fundamental rights regarding your personal information:
- You have the right to correct or update certain types of Personal Data.
- You have the right to request deletion of your Personal Data. If you choose to have your Personal Data removed from the Services, Developer will carry out your request within 30 days of verification, subject to extension, and we will only retain minimal Personal Data to document your request and the actions taken to carry out your request.
- You have the right to restrict certain processing of your Personal Data and the right to object to some types of processing of your Personal Data.
- You have the right to withdraw your consent at any time.
- You have the right to lodge a complaint regarding collection, storage, or processing of your Personal Data with a data protection supervisory authority in the country where you live or work.
6US residents
If you are a US resident, you may have rights under your state’s privacy laws, such as the California Consumer Privacy Act (as amended by the CPRA). We collect the categories of data described in section 2 for the purposes in section 3. We do not sell or “share” your personal data for cross-context behavioural advertising, and we do not use it for targeted advertising. Subject to your state’s law, you may have the right to know what we collect, to request access or deletion, to correct inaccurate data, and to opt out of any sale or sharing — and we will not discriminate against you for exercising these rights. To make a request, email support@dam-n.com.
7Data Transfer
We are based in Ukraine and serve players globally (including in the European Economic Area, the United Kingdom, the United States, and other regions). Because our multiplayer infrastructure and third-party service providers—such as Epic Games, Inc. and Valve Corporation in the United States, and Oracle Cloud Infrastructure in the European Union (Frankfurt)—operate internationally, your Personal Data may be transferred to, stored, or processed in countries outside your country of residence.
Whenever we transfer Personal Data outside the EEA or the UK, we rely on appropriate safeguards - such as adequacy decisions, the EU Standard Contractual Clauses, or the UK International Data Transfer Agreement - so that your data remains fully protected.
8Children’s Personal Information
A “Child” is a person under the age needed to consent to the processing of Personal Data in their country of residence (for example, 13 years old in the United States and between 13 and 16 years old in the European Union).
We do not knowingly collect Personal Data from a Child. If you are a Child, do not submit any Personal Data to us. If you become aware that a Child has provided us with Personal Data, please contact us at support@dam-n.com and we will delete it promptly.
